Though required to constitute medical boards under the Medical Termination of Pregnancy (MTP) Act to diagnose any substantial foetal anomaly, the state ofMaharashtrahas not done so thus far.
The HC noted that under the amendedMTP Actof 2021, the limitation to terminate a pregnancy, while extended from 20 to 24 weeks, carves out an exception in cases of foetal abnormalities.
The medical board has to consist of a gynaecologist, a paediatrician, a radiologist and other members notified by the state, says the amended Act which under section 2 (c) requires every state to notify the board.
