\nThe 91st Constitutional Amendment Act of 2003 amended Article 75(1A) of the Constitution to limit the size of the Council of Ministers at the Centre. It stipulates that the total number of ministers, including the Prime Minister, in the Union Council of Ministers shall not exceed fifteen per cent of the total number of members of the House of the People (Lok Sabha).

\nThis amendment was enacted to prevent oversized councils of ministers and to curb defection. A similar limitation was also placed on the size of state Councils of Ministers under Article 164(1A), limiting them to 15% of the total number of members of the Legislative Assembly of that state, provided that the number of ministers in a state shall not be less than twelve.
