State of Kerala (1973), the Supreme Court of India held that the preamble to the Constitution of India is a part of the Constitution and hence can be amended. The Court held that the preamble is not a mere recital of the objectives of the Constitution, but is a part of the Constitution itself. The Court also held that the preamble cannot be amended in a way that would alter the basic structure of the Constitution.<\/p>\n
The case arose when a Hindu religious leader, Kesavananda Bharti, challenged the validity of the 25th Amendment to the Constitution, which had inserted a clause in the preamble stating that India is a “secular” republic. Bharti argued that the amendment was unconstitutional because it violated the basic structure of the Constitution, which he said included the principle of secularism.<\/p>\n
The Supreme Court upheld Bharti’s challenge and held that the 25th Amendment was unconstitutional.
